These Terms of Service ("Terms") govern your access to and use of the website located at https://www.getelevateflow.com (the "Site") and any related services offered by Must Have Outlet LLC, doing business as Elevate Flow ("Elevate Flow," "we," "us," or "our"), a Texas-based marketing agency providing AI-powered cold email outreach services for mortgage brokers.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you may not use the Site.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding agreement to use the Site. By using the Site, you represent that you meet these requirements.

2. Services

Elevate Flow provides marketing and outreach services, including AI-powered cold email campaigns designed to help mortgage brokers connect with real estate agents and book qualified meetings. Information on the Site is for general informational purposes and does not constitute a binding offer until a separate written agreement is executed between you and Elevate Flow.

3. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable federal, state, or local laws or regulations
• Attempt to gain unauthorized access to the Site, our systems, or the systems of our service providers
• Interfere with or disrupt the operation or security of the Site
• Use automated means to scrape, copy, or extract content from the Site without our prior written consent
• Transmit viruses, malware, or other harmful code
• Misrepresent your identity or affiliation when contacting us or using Site features

4. Communications and SMS Terms

When you submit your contact information through the Site, including via our chat widget, contact forms, or scheduling tools, you consent to receive communications from Elevate Flow related to your inquiry. If you provide a mobile phone number, you also consent to receive text messages, which may include automated appointment reminders, scheduling confirmations, and follow-up messages.

Consent to receive text messages is not a condition of purchasing services, except where necessary to coordinate appointments you request.

5. Client Services and Separate Agreements

If you become a client of Elevate Flow, the specific scope, deliverables, fees, and terms of our services will be governed by a separate service agreement, proposal, or statement of work. In the event of a conflict between these Terms and a signed client agreement, the signed client agreement will control with respect to the services covered by that agreement.

6. Intellectual Property

The Site and its entire contents, including text, graphics, logos, branding, design, software, and other materials, are owned by Elevate Flow or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works from, or publicly display any Site content without our prior written permission, except as permitted by law.

7. Third-Party Services and Links

The Site may integrate or link to third-party tools and platforms, including scheduling services, chat widgets, analytics providers, and payment processors. We do not control and are not responsible for third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

8. Disclaimer of Warranties

The Site and all content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. 9. Limitation of Liability

To the extent permitted by law, our total liability for any claim arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (USD $100) or the amount you paid us, if any, in the twelve (12) months preceding the claim, whichever is greater.

Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

12. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or if necessary to protect the Site, our users, or our business. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.
